2. Applicability
- These Terms and Conditions apply to every offer from Misunara and to every distance contract concluded between Misunara and the consumer via misunara.nl.
- Deviations or additions are only valid if agreed in writing.
- If one or more provisions are (partially) invalid or annulled, the remaining provisions will remain in full force. The parties will agree on new provisions to replace them, as closely as possible in line with the purpose and intent of the original.
3. The offer
- The product descriptions are sufficiently detailed to allow for a proper assessment. Images are for illustrative purposes only and may differ from actual product (e.g., packaging/label changes).
- Obvious mistakes or errors in the offer do not bind Misunara.
- Availability is shown to the best of our knowledge, but may depend on stock levels and suppliers.
4. The agreement
- The agreement is concluded upon successful completion of the ordering process and receipt of payment confirmation.
- Misunara will confirm the order by email to the address you provided.
- If delivery proves reasonably impossible, Misunara will offer a suitable alternative or refund.
- Misunara is entitled to refuse an order in case of well-founded fear of misuse, non-payment or other circumstances that hinder execution (with refund of amounts already paid).
5. Prices and payment
- All prices are in euros, including VAT and excluding shipping costs, unless stated otherwise.
- During the period stated in the offer, prices will not be increased, except for changes due to statutory regulations (such as VAT) or obvious errors.
- Payment is made using the payment methods offered (e.g., iDEAL, credit card, PayPal, and other payment providers available in Shopify). Orders are processed after payment has been confirmed.
- Promotions/discounts are not cumulative unless explicitly stated otherwise.
6. Delivery and execution
- Misunara normally ships orders within 1–3 business days of payment, unless otherwise communicated.
- Delivery will be made to the address you specified via our logistics partners. The risk of damage or loss passes to you upon actual delivery to you or a third party designated by you (not the carrier).
- Upon receipt, check the condition of your shipment. Report any visible transport damage to the delivery person immediately and report it to Misunara within 48 hours, along with photos of the packaging and product.
- Shipping costs, delivery options, and estimated delivery times are listed during checkout.
7. Right of withdrawal (returns)
Distance consumer purchases – in accordance with EU guidelines.
- You have the right to cancel your order within 14 days of receipt without giving any reason (cooling-off period).
- After notification of cancellation, you have another 14 days to return the product.
- For a smooth process, please use our returns form or follow the instructions on the customer service page.
- You are liable for any diminished value of the product resulting from your going beyond what is necessary to establish the nature, characteristics and functioning of the product.
- Return costs are at your expense, unless it concerns an incorrectly delivered or defective product.
- Refunds (including standard outward delivery costs) will be made within 14 days of cancellation, but may be withheld until we have received the goods or you prove that they have been dispatched.
8. Exceptions regarding hygiene/cosmetics
- The following articles are excluded from the right of withdrawal:
- Products with a broken seal that cannot be returned for hygiene or health protection reasons (e.g. skincare/cosmetics where the seal/foil has been opened or the product has visibly been used).
- Products which after delivery are irreversibly mixed with other goods.
- Items with a limited shelf life that have been (partially) consumed or opened.
- If you receive an incorrect or defective product, please report it within a reasonable time (preferably within 48 hours) with photos. We will arrange for repair, replacement, or refund free of charge.
9. Warranty and conformity
- Legal conformity applies: the product complies with the agreement and reasonable expectations based on the offer.
- In the event of a defect within a reasonable period after delivery, Misunara will offer repair, replacement, or (partial) refund free of charge. We may choose the most appropriate solution, taking into account the nature of the product and the defect.
- Exclusions: Damage due to improper use, improper storage (e.g. exposure to extreme heat/cold), normal wear and tear or expired shelf life due to prolonged opening/storage.
- Always keep the order number and, if applicable, batch or lot numbers for smooth processing.
10. Complaints procedure
- Please submit complaints via info@misunara.nl with your order number, a clear description, and photos if relevant.
- You will receive a substantive response within 14 days. If a longer processing time is required, you will receive a confirmation of receipt within 14 days, indicating the timeframe.
- If this does not lead to a solution, you can use the European ODR platform: ec.europa.eu/odr .
11. Liability
- Misunara is not liable for any damage caused by using the product in violation of the instructions for use, warnings, or reasonable care.
- Indirect damage (consequential damage, lost profits) is excluded, unless required by mandatory law.
- Misunara's total liability for attributable failure is limited to the invoice amount of the order in question.
- Nothing in these terms and conditions excludes liability for intent or gross negligence or to the extent this is contrary to mandatory consumer law.
12. Force Majeure
- Force majeure means: circumstances beyond Misunara's control that temporarily or permanently prevent performance, such as strikes, fire, disruptions, epidemics/pandemics, transport restrictions, war, natural disasters or supply problems with third parties.
- In the event of force majeure, Misunara has the right to suspend performance or to terminate the agreement (in part) without liability for damages.
13. Intellectual property
- All (intellectual) property rights to content on misunara.nl (texts, logos, images) belong to Misunara or its licensors.
- It is not permitted to copy, distribute or otherwise use any content without prior written permission.
14. Privacy and data protection
- Misunara processes personal data in accordance with the GDPR. Please consult the Privacy Statement for information about purposes, legal bases, retention periods, and your rights.

15. Applicable law and choice of forum
- These terms and conditions and agreements are exclusively governed by Dutch law.
- Disputes will be submitted to the competent court in Rotterdam, unless otherwise prescribed by mandatory law.
Misunara reserves the right to change these terms and conditions. The version applicable at the time of your order applies.
